Eligibility and Authority

otoHost shall not be liable for loss or damage resulting from reliance on instructions, documents, communications, or commands reasonably believed to originate from an authorized representative of a legal entity. If there is reasonable doubt about the validity of such instructions, notices, documents, or communications, otoHost reserves the right to request additional verification. You also agree to be bound by the terms of this Agreement for transactions performed by any person on your behalf or using your information — whether or not authorized by you.

Information Collected by otoHost

otoHost may collect personal information you provide when using our website or services. Data Protection Policy

otoHost provides various hosting services that may involve the submission, collection, and use of personal information related to personal identification details, customer and business information. During your use of the Service, otoHost selects and categorizes your data to filter unrelated user content. You are considered a Data Controller under the Data Processing Agreement (DPA) and the Standard Contractual Clauses attached to the DPA. Your acceptance of the governing provisions in effect at the time Covered Services are purchased is also deemed approval and disclosure of the DPA and its annexes.

By uploading, publishing, or sharing User Content on otoHost services, you grant otoHost a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works from, distribute, publicly display, publicly perform, and otherwise exploit such User Content in all formats and distribution channels now known or developed in the future (including in connection with our services and business and on third-party sites and services).

You represent that you have all rights necessary to grant the license described above to otoHost and that your User Content and its use and provision comply with all applicable laws, rules, and regulations. otoHost has no obligation to scan, monitor, or review User Content; however, it has the right (but not the obligation) to deny access to, remove, or disable User Content that violates this Privacy Policy or is otherwise objectionable.

We are not responsible for loss, corruption, or damage to User Content; you alone are responsible for creating backups of your User Content. We may access, store, and disclose your account information and User Content when required by law or when we believe in good faith that it is reasonably necessary. otoHost may retain residual copies of removed or deleted User Content (but may not distribute, display, or perform them). We do not use User Content you mark as "confidential" or "password protected" to promote this Site or the businesses of otoHost (or its affiliates). If you have a website hosted by otoHost, you retain all ownership or license rights in your User Content.

Content Monitoring

otoHost may monitor your use of otoHost services — including your access to, use of, and interactions with the website, applications, and other content, and your communications with customer service and technical support teams — for the purposes of (i) ensuring the security and integrity of otoHost systems and services, (ii) detecting, preventing, and investigating fraud, spam, malware, or other harmful activity, (iii) providing customer service and technical support, and (iv) improving and optimizing our services.

As part of monitoring activities, otoHost may collect information about you and your use of otoHost services, including your IP address, browser type, operating system, device information, location data, and usage data. Information may also be collected about your interactions with the website, applications, and other content, such as pages visited, features used, and content accessed.

otoHost generally does not pre-scan User Content (even if submitted by a user on a site hosted at otoHost). However, otoHost reserves the right to review User Content to determine whether it complies with this Agreement. otoHost may remove materials that violate or otherwise breach this Agreement (whether on a site hosted at otoHost or displayed on this Site) and suspend the user's access to the Site or Services. In cases of suspected repeated violations, otoHost may terminate access and remove and delete data stored on its servers.

Liquidated Damages Policy

In the event of a breach of this Privacy Policy or any other agreement between you and otoHost, you agree that otoHost may claim liquidated damages of USD 1.00 per violation and may recover this amount in addition to all other remedies available at law or in equity.

You agree that the liquidated damages amount is a reasonable estimate of the harm we will suffer as a result of your violation and that determining and proving actual damages may be difficult or impractical. The liquidated damages in this section are not punitive but a reasonable measure of the harm otoHost may suffer as a result of your violation.

Upon written request from otoHost, you agree to pay the specified liquidated damages without requiring otoHost to prove actual damages or take any other action to enforce this section. otoHost's right to liquidated damages is in addition to all other remedies available at law or in equity.

Domain Name Policies

Uniform Domain-Name Dispute-Resolution Policy (UDRP)

All registrars must implement the Uniform Domain-Name Dispute-Resolution Policy ("UDRP"). Under this policy, most trademark-based domain name disputes must be resolved through negotiation, court proceedings, or arbitration before a registrar can cancel, suspend, or transfer a domain name. Bad-faith registration claims (for example, cybersquatting) may be handled through expedited administrative procedures when the trademark rights holder submits a complaint to an approved dispute resolution service provider.

To enforce the policy, a trademark owner may (a) file a lawsuit in a competent court against the domain name holder, or (b) in cases of bad-faith registration, submit a complaint to an approved dispute resolution service provider. For full information, see the ICANN UDRP page.

Uniform Rapid Suspension (URS) Policy

URS is one of the rights protection mechanisms offered in the New gTLD Program. It complements the existing UDRP by providing trademark/rights holders with a fast and low-cost remedy in the clearest infringement cases. Inter-Registrar Transfer

Registered Name Holders must be able to transfer domain name registrations between registrars provided the gaining registrar's transfer process meets the minimum standards of this policy and the transfer is not prohibited by ICANN or Registry Operator policies. Registrar Transfer Dispute Resolution Policy

Registrars are encouraged to resolve disputes in inter-registrar domain name transfers primarily between the relevant registrars. If this fails and a registrar chooses to file a dispute notice, the applicable procedures are published here.

Registrant Rights and Responsibilities

For domain name registration, the Registered Name Holder (Registrant) must use the services of an ICANN-accredited Registrar. The Registrar must sign the Registrar Accreditation Agreement (RAA) with ICANN. The RAA sets out various rights and responsibilities for Registrants; additional rights and responsibilities are defined in separate ICANN policies.
